The St. Ives Elements "Indulge Yourself" Sweepstakes (the "Sweepstakes") is sponsored by Alberto-Culver USA, Inc., 2525 Armitage Avenue, Melrose Park, Illinois 60160 (the "Sponsor"), and administered by US Sweepstakes & Fulfillment Co., 625 Panorama Trail (Bldg. 2, Suite 100), Rochester, New York 14625 (the "Sweepstakes Administrator"; together with Sponsor, the "Sweepstakes Entities").
1. How to Enter: Sweepstakes begins at 12:01 AM Eastern Time (“ET”) on April 25, 2008 and ends at 11:59 PM ET on June 30, 2008 (the “Promotion Period”). To participate, you must visit the St. Ives Elements website during the Promotion Period at http://www.stives.com/elements-sweeps (the "Sweepstakes Site"), and follow the online prompts to enter your name, mailing address (no P.O. Boxes), and email address, and to submit your entry. Limit: one entry per person, per email address, per day during the Promotion Period. All Entries must be received by 11:59 PM ET on June 30, 2008 or they will be void. The Sweepstakes Site’s database clock will be the official timekeeper for the Sweepstakes. Incomplete entries will not be accepted and are void. Entries that are forged, altered, or generated by a macro, bot, or other automated means will not be accepted and are void. Entries made by any other individual or any entity, and/or originating at any other web site (other than the Sweepstakes Site) or e-mail address, including, without limitation, commercial sweepstakes subscription notification and/or entering service sites, will be declared invalid and disqualified. In the event of a dispute regarding the identity of the person submitting an entry, the entry will be deemed to be submitted by the person in whose name the email account is registered at time of entry, but only if that person meets all other eligibility criteria. Entries will not be acknowledged or returned.
2. Eligibility: Entry is limited to legal residents of one of the 50 United States or the District of Columbia, who are the age of majority in the state of residence at time of entry. Employees, officers, directors and agents of Sponsor and its subsidiaries, affiliates, independent sales distributors, advertising and promotional agencies, printing vendors, (and immediate family members or those living in the same household with such individuals) are not eligible to participate. For purposes of this Sweepstakes, immediate family members are spouse, parents, in-laws, grandparents, siblings, children or grandchildren of the entrant. All federal, state, and local laws and regulations apply.
3. Prizes: Ten (10) grand prizes (each a "Grand Prize") will be awarded, each in the form of a SpaFinder® gift certificate that can be used, in the winner's discretion, to purchase one (1) year’s worth of manicures/pedicures (based on one (1) manicure and one (1) pedicure per month over a twelve month period, for a total of twelve (12) manicures and twelve (12) pedicures per Grand Prize), or any other spa services available at participating spas. Total ARV of all prizes being awarded: $9,000.
4. Drawing and Notification: All Grand Prize winners will be selected in a random drawing, under the supervision of the Sweepstakes Administrator, on or about July 31, 2008, from among all eligible entries received, provided that no individual may win more than one Grand Prize. Each Grand Prize winner will be notified by phone, or by other means to be determined by Sweepstakes Entities in their sole discretion, and confirmed in writing that they are a potential prizewinner on or about August 7, 2008. In each notice, Sweepstakes Administrator will provide documentation that the winner must execute before being entitled to redeem his or her prize. Each Grand Prize winner will be required to execute and return an Affidavit of Eligibility, a Liability Release, and, where legal, and where permissible, a Publicity Release (collectively, the “Release Documents”), within seven (7) days of written notification. All prize claims and Release Documents are subject to verification by the Sweepstakes Entities. Limit one Grand Prize per family or per household.
Prizes will be shipped to the mailing address provided at entry within approximately 6–8 weeks of the notification. If any winner notification or Sweepstakes communication is rejected or returned as undeliverable, or if a potential winner cannot be reached after a reasonable attempt has been made by the Sweepstakes Entities (as determined by Sponsor in its sole discretion), such winner may be disqualified and an alternate winner may be selected. Failure by any winner to respond to notification and/or failure to provide required proof of eligibility, Release Documents, or any other required documentation in a timely manner may result in disqualification and selection of an alternate winner. Non-winning entrants will not be notified. Winning a prize is contingent upon fulfilling all the requirements set forth herein. All prizes legitimately claimed will be awarded. Odds of winning will depend on the total number of eligible entries received.
5. Prize Conditions and Limitations: All entries become the property of the Sponsor, who reserves the right to substitute a prize of equal or greater value for any reason, including, without limitation, due to prize unavailability. No substitution or transfer of prize is permitted, and no cash equivalent for any prize is offered, except at the sole discretion of the Sponsor. In no event shall more prizes be awarded than the number stated in the “Prizes” section (paragraph 3) above. All federal, state, and local taxes on prizes offered, if applicable, are the sole responsibility of the winners, and each winner may be required to fill out and return to Sponsor certain tax forms in the timeframe specified by Sponsor. An IRS Form 1099 will be provided to each Grand Prize winner and a copy sent to the IRS in each Grand Prize winner’s name. Acceptance of a prize constitutes permission from the winner to the Sponsor and its agencies to use such winner’s name, picture and/or likeness, voice, and biographical data for advertising, marketing and publicity purposes, throughout the world, including on the internet, without further compensation, notice, review, or approval, except where prohibited by law. Prizes are awarded “as is” with no at-law or implied warranties whatsoever. Stated ARV of each Grand Prize (i.e., gift certificate amount) is based on the average price of manicure/pedicure services, plus applicable sales tax and gratuities, and Sponsor makes no promise that such amount will cover all costs related to the above-stated number of manicures/pedicures in all instances or at all participating spas. Actual costs of services and applicable sales tax will vary depending on participating spa. All prize details not specified in these Official Rules will be determined in Sponsor's sole discretion.
6. Sweepstakes Conditions: Sweepstakes is subject to all applicable federal, state and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Entities (which are final) and waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.
Each entrant agrees to release, discharge, indemnify and hold harmless the Sponsor, and its subsidiaries, affiliates, directors, officers, employees and agents, from and against any claims, damages or liability whatsoever due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this Sweepstakes.
Sponsor is not responsible for errors, typos, or misprints in these official rules, in any Sweepstakes-related advertisements or other materials or any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any technical or human error which may occur in the processing and/or transmissions in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or authorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to participants or to any other person’s computer related to, or resulting from, viruses or participating in or downloading of materials in this contest. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, and to select winners from all entries received up to the time of termination.
As a condition of entry, all entrants agree not to damage or cause interruption of the Sweepstakes and/or to prevent others from participating in the Sweepstakes. Sponsor reserves the right, in its sole discretion, to permanently disqualify any person it believes has intentionally violated these Official Rules or has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted to the full extent of the law.
